Jared Scott focuses his practice on helping clients avoid and resolve legal problems.  Whether that means taking a case to trial or negotiating a favorable settlement before a lawsuit is even filed, clients count on Jared to get the job done effectively and efficiently.  He aggressively and successfully represents plaintiffs and defendants in the construction, network marketing, legal, financial, healthcare, real estate, insurance, and natural resources industries. As a result, Jared has repeatedly been selected as one of Utah’s Legal Elite by his peers.

Representative Matters

  • Partnership/Business Disputes

    • Acted as trial counsel in an arbitration resulting in a $1.3 million fraud judgment and the removal of defendant’s ownership interests in start-up manufacturing company. The arbitration award, which included punitive damages and attorneys’ fees, was later affirmed by the district court and the Utah Court of Appeals.

    • Negotiated a substantial monetary settlement in a dispute over distributions from the sale of a family-owned business.

  • Trade Secrets / Confidential Information

    • Secured summary judgment and award of attorney’s fees on behalf of an international tool manufacturer accused of causing $2 million in damages arising out of alleged breaches of contract and misappropriations of trade secrets.

    • Obtained substantial settlement on behalf of insurance brokerage in case involving misappropriation of trade secrets including customer lists.

    • Represented former employee and new employer in trade secret claims involving alleged misappropriation of sales data and customer information.

  • Class Actions

    • Represented plaintiff classes in obtaining over $140 million in court-approved settlements since 2018.

    • Acts as local and co-counsel in class lawsuits and derivative actions pending in Utah and around the country.

    • Acted as defense counsel in class actions involving securities violations, consumer claims, and statutory causes of action.

  • Construction

    • Acted as trial counsel in arbitration resulting in judgment in excess of $250,000 plus fees against home builder that refused to perform on fixed-price contract due to alleged cost increases.

    • Secured summary judgment including compensatory damages, statutory penalties, and attorney’s fees against disaster remediation contractor for failure to pay for services rendered. Total judgment exceeded invoice amounts by more than $100,000.

    • After obtaining favorable evidentiary rulings on the eve of trial, negotiated a settlement of multi-million dollar fraud claims against condominium developer for pennies on the dollar.

    • Represented contractors, subcontractors, and owners in negligence, construction defect, and payment claims throughout the United States.

  • Network Marketing

    • Negotiated the settlement of consumer class action claims against high level network marketing distributors for less than $10,000 each while other defendants paid millions of dollars to settle similar allegations in the same lawsuit.

    • Secured summary judgment in favor of a network marketing company on $30 million dollar breach of contract claims brought by a ground-floor level distributor. Argued and briefed case at the Utah Court of Appeals, resulting in affirmance.

  • Professional Liability

    • Represented an environmental engineering firm in a dispute with oil and gas companies and municipal authorities involving an EPA-authorized cleanup of a polluted waterway.

    • Represented a structural engineering firm in a dispute over the construction of a reservoir.

  • Healthcare

    • Acted as first-chair attorney in administrative trials before the Utah Division of Medicaid and Health Financing, obtaining favorable results and creating precedent that resulted in the dismissal of dozens of other similar claims.

    • Obtained summary judgment in favor of health insurer and its physician employee arising out of a disputed coverage claim.

  • Real Estate

    • Obtained a favorable settlement for a real estate purchaser in a dispute against sellers and real estate agents that failed to disclose known defects in the purchased property.

    • Defended a real estate developer and broker against fraud and statutory claims arising out of a mass sale of developed lots in the St. George area.

  • Insurance

    • Secured summary judgment on behalf of fidelity insurer for claims arising out of alleged embezzlement by a company executive.

    • Negotiated a favorable settlement of claims involving disputed insurance coverage over watercraft rentals.

  • Natural Resources

    • Secured an award of $1.5 million on summary judgment in favor of a contractor in a dispute with an oil and gas developer related to geotechnical surveying services.

    • Assisted an investor in securing a $20 million fraud judgment against a publicly-traded energy company on claims arising out of a failed farmout agreement.
